Brown County Parks and Recreation.  Update to a Master Plan (including location of all hiking trails available to the public?) under development 

Hoosier Hikers Council – Tecumseh Trail.  In terms of hills, the Tecumseh Trail is often considered a gentler version and training ground of the Knobstone Trail, a 52-mile one-way path that is further south in Indiana, near the city of Salem.  While the Tecumseh’s path does consist of many large hills, ascents are not typically as steep, long, or frequent as those of the Knobstone Trail.

Knobstone Hiking Trail Association.  The Knobstone Hiking Trail Association (KHTA) was formed in 2013 to become the steward of this great trail. July 20, 2022. Presentation – Commissioner meeting. A Knobstone Hiking Trail Association (KTHA) founding member and attorney, Tony Abbott, will present a resolution we hope the county commissioners will adopt to make it clear that the Indian Hill Road Railroad Crossing closure was not intended to close the Tecumseh Trail. If they will adopt the resolution, this may start a process to open the crossing for pedestrians.

• As co-chairs of the bipartisan, bicameral Indiana Legislative Trails Caucus, we are writing to urge you to reestablish a pedestrian crossing for the Tecumseh Hiking Trail across the Indiana Railroad at Indian Hill Road. The rail crossing closure has blocked through-hiking on the Tecumseh Hiking Trail that connects with a number of other trails to form a trail system spanning over 160 miles and 8 counties. Without the pedestrian crossing, the only way to get across the railroad is to take a five to six mile walking detour.
  This is a significant impediment for through hikers and defeats the goal of having a continuous trail system.

  (IRRC) join with KHTA and other stakeholders in creating a pedestrian crossing at the location where Indian Hill Road (IHR) crosses the IRRC right of way near IN-45 in Trevlac, Brown County, Indiana.

The decision to close the rail crossing at this location has resulted in the blocking of the Trail, adversely impacting hikers. The Tecumseh Hiking Trail is 42 miles long. It adjoins the Knobstone Hiking Trail in the Hoosier National Forest and connects with a number of other trails to form a trail system spanning over 160 miles and 8 counties. The rail crossing closure has blocked through-hiking on this trail system. Without a pedestrian crossing, the only way to get across the railroad is to take a five to six mile walking detour. For those seeking to backpack or hike across the trail, this is a significant barrier.

• • Architectural project manager Eric Muehlhausen at the Nashville Technical Review Committee meeting on Nov. 4 that changes had been made to the original plans for a proposed luxury RV campground that were presented to the Brown County Board of Zoning Appeals in October. The request was denied by the BZA unanimously due to concerns about traffic, sewer connectivity and flooding in the area.

What is Brown “County’s” Economic Engine?
Spoiler Alert: It is NOT tourism.

For Brown County, the overall beauty of the landscape and terrain is what has attracted residents, artists, and visitors.  Brown County is the most forested county in the State. The landscape also attracted the artists and led to the State creating the State Park.  Tourism emerged to serve the visitors.  Outdoor Recreation (OR) and an appreciation of the landscape – especially in the Fall, have been main attractors.

The MAIN REVENUE GENERATION “engine” for the county is RESIDENTS! The majority include individuals that live here and commute outside the county (or can work from home) for the better paying jobs, residents in occupations other than tourism, and retirees.

• • The average weekly wage in Brown County is lowest in the State.
• The Brown County Community Readiness Initiative, a survey and economic assessment conducted by the Ball State Economic and Research Institute, concluded that Brown County’s greatest potential for economic growth is not tourism, but as a bedroom community. – BC Democrat – Sara Clifford
• The expansion of broadband within the county is a new and positive change. It supports the live her, work elsewhere philosophy.
• The Regional Opportunity Initiative (ROI) in which Brown County is a member, have identifed that there are more good jobs in the region than individuals to fill them.

In 2019, 7,126 residents reported adjusted gross (taxable) income of $425 million dollars. This is the source of the revenue for the county government.  The county is primarily funded by income and property taxes.

  • County Economics – Income Trends

A study in 2017 by Rockport Analytics identified that tourism accounted for 636 jobs and $12.2 million in wages and proprietor income.

An updated 2020 Rockport Analytic Study shows $12.1 million in wages.

Increases in Nashville’s assessed property values are the lowest in the county which means other residents are paying higher taxes to help fund the cost of government and infrastructure.

• • Property Assessments and Taxes 2012-2019

Government data indicates service level jobs are among the lowest paid. The Rockport Analytics study identifed “an average wage of $19,259 in gross wages.”

The State is primarily funded by Sales Tax and Income Tax.  Increasing revenue from sales tax is the driver for subsiding the marketing of tourism via the innkeepers tax.

Revenue from the innkeeprs tax is a county assest. Review and approval of how this money is spent is the statutory responsiblity of the County Council.  The revenue from this tax can be spent on just about anything that leads to attracting tourists.

• • Examples:  A “music venue”, tourist center, historical preservation, wellness, agriculture, education,  recreation, etc.  Additional examples on types, categories and tourism related issues provided at Tourism-Wikipedia.  See also overtourism and too much tourism.
  • The Convention Visitors Commission (CVC) is responsible for developing a plan and budget and the Conventions Vistors Bureau (CVB) is provided funing to market tourism. Before the Music Center (which now uses the revenue for mortgage and operating expenses),  the CVB was given approximately 95% of the innkpeers tax revenue.  Results from the marketing strategies have not been made publically available.
  • The Commissioners are responsble for developing a County Comprehensive Plan that should include a vision for tourism.  The current plan does not include this vision.  Consequently, residents not involved in the tourims industry have no input on how and where the revenue from the innkeerps tax will be spent.  However, this can be easily changed by electing more resident focused representatives.

Brown County Music Center (BCMC).  The Project was led by innkeepers that benefirectlyitted indrectly from the support of county government and investment of tax dollars (more heads in bed) with no risk. Elected officials fast-tracked the process and refused to hold any public  meetings with the exception of the meeting needed to approve the project.

• • GUEST OPINION: Time will tell what music center’s impact will be, by Tim Clark. The stated aim for this project was to promote and support tourism and the tourism industry primarily in Nashville. In fact, it was stated at a June 2017 presentation at the Playhouse that when using the revenue from the innkeepers tax to finance a tourism-related project, the investment had to result in overnight stays, i.e., “ heads in beds.” This was not a true statement, and to my knowledge, was never retracted publicly. Revenue from the innkeepers tax can be used for any project that promotes tourism.

County Economic Development Strategic Plan

• • Econ Development Strategic Plan and Timeline – The Plan was “accepted” for payment by the commissioners but not approved by the commissioners nor reviewed or approved at a formal meeting of the Redevelopment Commission (RDC). In addition, the public did not have the opportunity  to comment.

  • The entire 79-page plan first became public after a Nov. 20 public hearing with the Brown County Commissioners and Brown County Redevelopment Commission. However, neither group had read the entire plan by the time of the hearing, and the public hadn’t had an opportunity to see it yet.

County Economics

• An income survey commissioneed by the County RDC identifed that 53.1% of county residents are in the low to moderate income level.  This qualified the county for federal planning grants. Approximately over 50% of students in the schools qualify for free or reduced lunches.
• Income Trends 1999-2018. Trends on those reporting income of $50,000 or more are trending up. Trends on those making $30,000 and less trending down.

Trends in Tourism.

• Nashville has identified its intent to be a “driver” of regional tourism.
• From seasonal to year round.  Hard Truth Hills and The Brown County Music Center attract more year-round tourism. They also attract additional tourism ventures such as tourist home rentals, the planned resort at Rawhide Ranch and a new tiny house campground.
• The Board of Zoning Appeals (BZA) voted against a 185 Site RV Campground.  Views expressed support for the project but not the location.
• Despitre the increase in the number of tourists, state highways (46 and 135) and county roads will likely remain at two-lanes for the foreseeable future.
• Another change is in the increase in the number of liquor licenses.
• Mountain-Biking another new attraction.
• Nov 19, 2021 — Out-Door Music — Nashville Town Council working on changes to the Noise Ordinance.  Nashville Noise Ordinance – For  the Record
  • DRAFT – Town Noise Ordinance  .”..It shall be unlawful under this ordinance to: “Intentionally create sound/noise louder than 90 decibels between the hours of 10:00 p.m. and 7:00 a.m. Sunday through Thursday or between 11:00 p.m. and 7 a.m. on Friday or Saturday.”

Nashville – Development and Tax Strategy

• Nashville includes most if not all of its territory in a Tax Increment Financing (TIF) District. This means that the town (not the county) retain the increased property tax revenue as a result of  development.
• Nashville has also identifed their desire to expand sewer service to areas outside the town limits without identifying a need. Expansion may help to spread the cost and maintance to more customers.
• Nashvilles Strategic Advisor on the proposed Little Opry Apartment Complex: “And so to get sanitary sewer there and get people off septic, obviously is an EPA mandate. I’d love to see that.”

  • Unnecessary infrastructure costs (sewers for example) add to the cost of living. The Helmsburg rate of $92.50 is outrageous. And many residents may need help with reparing and replacing septic systems.

Challenges 

• Brown County has one of the highest median home prices in the state. This reinforces the fact that there is still a demand for people to live her but generate income from outside the county.
• The lack of “Affordable Housing” has been a recurring topic that market forces (supply/demand) have not resolved. The tourism industry may be especially effected by attracting workers at modest pay scales that can not afford to live in the county.
• ROI Housing Study – Brown County’s section starts on page 43.
• Avoid Gentrification?  Policies that lead to increases in the cost of living (taxes, utilities, housing) where the lower income residents are replaced with those with incomes in the middle to higher income levels.

Schools – Steady Decline in Enrollments 2008-2022 (Democrat, Nov 17, 2021 Board OKs budget for next year as enrollment declines

• Causes of the decline? State code changed in the 2008/09 period that allowed residents to send their kids to any public school without cost. Residents that commuted to jobs outside the county could choose schools in the surrounding counties. Home Schooling options also made it more attractive for parents to support this option. On demographics, we have one of the oldest median ages in the state. Low enrollment is also due to lower birth rates. And, high median home prices and lack of an inventory of homes in the starter (affordable) range may also be contributing to the decline. Most residents have always chosen to live here but commute outside the county for the better-paying jobs. Differences now may be the pay of jobs, and more competition for housing in the county which drives up prices.

Tax Policy

• Given the tax base, the commissioners and council chose to rely on increases in income tax and keep property taxes low.  The income rate became one of the highest in the state and was doubled in 10 years, and maxed out. The county recently shifted policy from income to property.
• Property tax rates have been among the lowest in the state.  This makes owning property, tourist rentals, and second homes more attractive. This also contribites to higher median home values.
• 2021 Indiana Income Tax Rates by County page 3. Brown County rate: 025234 or2.5234%.  The max limit set by the state is 2.5% but they allow a cost-of living increase. The highest rate in the statye is Pulaski county at .032475*

  • “People say, ‘Well, we can’t change.’ But we can change and still retain some of the flavor of Brown County. We need people to live here. I’m in the tourist business but we don’t want to turn this town over to the tourists. You can go to Gatlinburg if you want to see what happens to a town that turns it all over to business. It’s not a town anymore—it’s a shopping center. We need people here. This town needs to be alive.”

Deming’s contributions in the area of quality improvement were recognized by Fortune magazine as being among the 20 that have shaped the modern world of business and by U.S. News and World Report as one of nine turning points in history.

The top turning point was identified as “The Apostle Paul, whose preaching and eloquent writings led to mass acceptance of Christianity.

Edwards Deming. Those who might be interested in this course should read the Preface and Welcome in the file “A. PLEASE START HERE” to discover why Dr. Neave refers to this as an active-learning course.

This is an excellent supplement and follow-on to what Deming presented in his Four-Day Seminars. I had the opportunity to attend one these in 1988.

Henry Neave was a friend, student, and colleague of Dr. Deming. Deming wrote the forward to Neave’s book – The Deming Dimension.  In this book, Deming provides the secret on page 57 to understand the foundation of his theory, principles, and method. He stated the following:

“If I had to reduce my message for management to just a few words, 
I’d say it all has to do with reducing variation.” WED

Excerpts from a LinkedIn Discussion on supporting improvements at the national level. It started with Congress wanting to spend trillions on an infrastructure project:

• Does anyone know what the process is for tracking outcomes and ensuring the money is spent as intended? Does this include frequent reporting on status? Any examples from past spending bills? Any reports that the money spent was wasted? How has the overall process for accountability improved over time?
• Our system was designed to support continuous improvement. The flaw in the system is the lack of a shared method. It would also help if “We The People” acknowledged that we are “top management.” You can delegate accountability to elected officials but not responsibility.
• A study referenced at Represent.US – The Problem identifies results from a study that indicated that data from nearly 2000 public opinion surveys that compared what the public (top management) wanted to what the government actually did, concluded that the opinions of 90% of Americans (top management) have essentially no impact at all.  This finding was not challenged by the legacy media but led to whether America was functioning as an oligarchy.Elected officials should be serving as our “lobbyists” in supporting legislation that leads to outcomes where we all benefit, or at least are not any worse off in the long term. But, this is probably not enough – citizens need to become educated and engaged. And, we need a “method” that will be used to determine when change (new laws, policies, regulations) leads to improvement.
• Deming identified that you just needed a critical mass of leaders to support the needed changes. This includes a relatively small percentage of individuals within groups, communities, organizations, industries, and countries.  These leaders would need to have a basic understanding of variation, including common and special causes of variation, tampering, stable and unstable systems in the context of the PDSA cycle. This should be supported using common language and terms and avoiding the quality jargon. The aim is to support changes that lead to results where everyone can benefit, or at least, are not any worse off in the long-term. The basics can be successfully taught and applied at the middle school level.  The challenges are from those that support suboptimal (zero-sum) outcomes, want to remain in their comfort zones, and/or support and have a vested interest in the status quo.  These types of challenges have always required leadership to help overcome.  What’s NEW is the Deming-based methods. Anyone that has made and sustained a change has applied the new methods using different terms. A shared method and framework can produce significant and immediate improvement at any level.
• … “hidden truths.” It’s a given – every man-made system has a level of corruption. The degree of corruption correlates to the level of transparency. And depending on the moral standard used, “truth” can be relative.

On whatever plot of land you occupy, try to raise some food, and if possible become friendly with local farmers. No one can escape what is coming, as it will be global in nature, but you can take steps now to increase your chances of survival.

The Pursuit of Power

Humankind is imperfect. Individuals have always sought power, and power always corrupts. Power may be more addicting than drugs. The centralization of power within a political system has never ended well. The U.S. founding fathers designed a system of government to provide the needed checks and balances on power, and challenges to the Constitution continued after it was signed. The erosion of these checks and balances has contributed to the political and cultural divide within America.

My speech at the rally incorporated both a conservative and a biblical worldview. And, of course, there was disagreement, opposite and opposing positions and philosophies. Note: Taking action to improve a process to achieve a more ideal outcome has a 100% success rate if you learn something new. But, it takes effort, time, patience, and commitment to work through the repeated cycles of a Plan, Do, Study, Act (PDSA) cycle. Spiritual Warfare

Good advice about stocking up, having some cash, and having paper (hard copy) documentation for information including bank and IRA accounts, etc. was given during the Sunday service on November 21, 2021, by Pastor Tim Conboy of New Life Community Church in Brown County, IN: Presentation (starts around 57:48) on the topics of The Great Reset and End Times. 

Pastor Conboy’s presentation on Globalism, The Great Reset, and Biblical Principals provides more background on the threat from globalists represented by the World Economic Forum. Significant among these is “cyber-COVID.” A follow-up on the topic regarding the digital equivalent of COVID includes a “fictional” (worst-case) scenario for possible effects. Cyberwarfare is likely more of an option than EMP or Nuclear.

In his November 29, 2021 Sunday sermon, Crucifying Christ Again: Is The Apocalypse Now? Father John Echert draws an analogy between what’s going on globally today to what was happening inside the walls of Jerusalem in 70 AD. That was AN apocalypse. Is this THE apocalypse now? Looking at the signs of the times, Father argues that at the very least, the mystical body of Christ is entering into another passion very similar to that which Jesus Christ suffered 2000 years ago. What should we do? Well, here’s a hint: Of the estimated million people who were slaughtered by the Romans in 70 AD, not one Christian perished. Why? Well, that’s the point of this Sunday sermon. (Reference: Remnant Newspaper/TV)

Michael Matt, editor of Remnant Newspaper (Catholic), gave a lecture at the 2021 Roman Forum, “Band of Brothers: The Remnant and Other Warriors of the Movement.”  He covers the history of the split in the church between the traditional Catholics (counter-revolution – the tip of the spear) characterized by those that continue to support the Latin Mass and pre-Vatican II traditions and the New Mass and Church created from Vatican II. The Pope supports The Great Reset, Covid Policies (Plandemic) and a Global World Order.  Archbishop Viganò (a traditionalist—more references below) is one of the more outspoken members of the clergy opposing the Pope and his leadership.

In December 2021, Norman Podhoretz published an opinion piece on the Spiritual War for America in the Wall Street Journal. He stated, “It’s a war, in my view. Many people are reluctant to see it in those terms. I mean, people say it’s a lot like 1858 and so on, but I don’t see it as a prelude to a civil war and 600,000 Americans dead. That’s not my meaning. But spiritually it’s a war.” Mr. Podhoretz keeps returning to the theme of war, a war made necessary, in his view, by the anti-Americanism of the political left. Is the hatred of America worse than it used to be? “Unquestionably,” he says. “This ‘woke’ business—Critical Race Theory, Black Lives Matter, all of it—is just pure anti-American hatred…We’re in a war, and it’s a war to the death. Now they actually admit it.”

Michael Anton wrote on Blue America’s Messaging Problem. He summed up their message: “We must rule you, punitively, forever—and if you so much as complain, you are literally Hitler. All shall love me and despair…That is Blue America’s message to Red. Whether or not it can succeed, and for how long, are the core political questions of our time.”

The Democrats’ exploitation of Jan. 6 gives away their game. Ben Shapiro suggests we call Jan. 6 for what it was: “an ugly but not pivotal moment in American history.” He goes on to say, “January 6 [2021], to opportunistic Democrats, is the all-purpose excuse to use the entire weight of their party to push for a radical revision of Senate rules and federal elections. Bob Unruh reported that an analysis by Real Clear Investigations found BLM riots caused 1,300 times as much damage as Jan. 6 violence, but there’s been “no comparable scrutiny.” Updated: Capitol-BLM Riots Side-by-Side Comparison (Real Clear Politics)

“Every Day Is Hunt Down Conservatives Day Now.” – New York Times telegraphs the left’s intent to use the January 6 anniversary to repress conservatives

Dick Cheney reappeared in the House of Representatives on the anniversary of January 6^th, where the day was repeatedly described as a “coup” or an “insurrection” (instead of something closer to the American version of a soccer riot). Matt Taibbi’s article, A Tale of Two Authoritarians, says his reappearance helped identify the true villain on the scene.

Trump’s Christmas message earns praise from Franklin Graham

Selwyn Duke compared the egos of Trump and Obama in God and Ego: Trump vs. Obama. Duke first shares a snippet of what Trump said while speaking at Dallas’s First Baptist Church in December 2021: “Our country has a Savior. And it’s not me …Remember that Jesus Christ is the ultimate source of our strength and our hope.” And then he compares that to an Obama interview in the Chicago Sun-Times during his 2004 Senate run: “While running for the U.S. Senate from Illinois in 2004, Obama was interviewed by Chicago Sun-Times religion reporter Cathleen Falsani, and what he revealed was striking, indeed. Obama spouted boilerplate leftist philoso-babble for much of the interview. One interesting point, however, was when Falsani asked him, ‘What is sin?’ Obama’s answer? ‘Being out of alignment with my values,’ he said.”

America is under unprecedented attack. Challenges include a more pervasive belief that man and a larger, more tyrannical and controlling government inspired by Marxist philosophies and led by globalist elites will lead to man’s version of utopia. History, however, indicates that this “utopia” is hell on earth. The elites believe the failures and mistakes of past efforts by the elites of those times can be avoided through their unique brand of leadership in support of their vision of utopia. And, within any group of elites, there are always a few that work to further consolidate power under their leadership.

Marxist Revolution in the Making in America, Expert Warns

Biblical prophecy identifies that humans are not basically good. We are all sinners (imperfect). Another insight is that some humans will continually seek to gain, centralize, and abuse power. In a political context, this eventually leads to a “one-world” (global) government that the antichrist will control, followed by Armageddon. Armageddon is the final battle between good and evil. As prophesized, Jesus Christ will return and defeat evil. He establishes peace on earth for one thousand years and then for eternity. “But about that day or hour no one knows, not even the angels in heaven, nor the Son, but only the Father.” – Mathew 13:32, NIV

The United States is a secular country whose design was influenced by Judeo-Christian principles. Our founders, many of whom were Christians, understood the Bible, lessons from history, and insight into human nature. The Constitution includes built-in checks and balances on power. The Bill of (Human) Rights empowers “We the People” [top management] to work together in pursuit of “a more perfect Union.” This requires that changes result in outcomes where everyone benefits (more needs are met), or at least, are not any worse off in the long term. This is in contrast to our current situation where actions motivated by hate and contempt are taken to divide, weaken, destroy, and transform the country.

Regarding the term “perfect,” in the Christian context, only God is perfect; man is imperfect and expected to improve. Jesus Christ is the standard of perfection. These facts align with the principles of continuous improvement and quality management. Reducing variation from the ideal (more perfect) leads to more needs being met and less harm on people when needs are not met. Additional information can be found here: Success through Quality.

Challenges to the Constitution continued after it was signed into law. These challenges contributed to Benjamin Franklin’s response to a group of citizens asking what sort of government the delegates had created. His reply: “A republic, if you can keep it.” 

Have We “Kept It?”

The checks and balances on power have been slowly eroded to the extent the U.S. may now be functioning more as an oligarchy than a republic. Key findings from a study referenced at Represent.US concluded the following:

“… data from nearly 2000 public opinion surveys … compared what the public wanted to what the government actually did. What they found was extremely unsettling: The opinions of 90% of Americans have essentially no impact at all.”

This erosion of the checks and balances on power manifests in the harm caused today by the leftist strategies and policies pursued by the current administration and its allies.

The Constitution and Bill of Rights are our last line of defense and provide citizens the power to fight back against the policies of the Leftists and to mitigate their destructive effects. We can work together within our local community to work through these turbulent and chaotic times while strengthening our republic. Eventually, there will be a transition to The Better Times – the banishment of evil and peace on earth—in other words, THE GREATEST RESET.

This includes leftist policies including “Build Back Better” that align with The Great Reset. This scenario reflects the desire for an expansion and centralization of government control (more power in the hands of the few) in all aspects of life with the belief that the leftist vision of utopia is best for America. These policies are like a virus that is deliberately aimed to weaken and destroy the country. Nov 8, 2021.  Nashville responsible for changing the zoning to B3 when the property was annexed. Per the County Planning Department, “Legislative bodies (in this case the Town Council) have the power to change zoning designations during Annexation procedures without input from the Plan Commission.”

• This begs the question: What was the process used by the council to make this change? What was the legal basis and required steps? Were public meetings held? Were neighbors notified? Is documentation available?

Nov 4, 2021.  Nashville Technical Review Committee — 1 p.m., Town Hall. Agenda includes review of new buildings project by Stephen Alexander at 1415 East Old State Road 46.

• DRC/Technical Review Board Meeting – Notes. The developers will be putting in two retail buildings in separate locations on the property and a swimming pool. No specifics on the type of retail were provided. The design will be a “Farmstead Look.” The building will be on the north side of Salt Creek in a “Flood Fringe area. Per the town, they can be hooked up to the sewers. And before getting building permits, they will have to meet all requirements to include  flood-way related issues. Not much anyone can do regarding the development. One of the buildings will be 3,700 sq.ft. and the other 4,000. Utility building is 1500 sq.ft.

Nov 2, 2021. Zoning boards approve, deny different tourism attractions By Staff Reports 

• …   the Brown County Board of Zoning Appeals denied a special exception to allow a 185 spot luxury RV campground.

  The Salmon Room at the Brown County Office Building was full on Oct. 27 with around 40 residents.

  Over an hour 23 residents spoke against the proposed project with most of them living on or owning property near the proposed park area in a field off of Old State Road 46 near the intersection of Clay Lick Road.

  The petitioner, Stephen Alexander, was requesting a special exception for a private recreational development on 20 acres of his 71.76 acre parcel.

  The property is located within town limits and is zoned business (B3), which is a service and warehouse business use designation. Under that zoning all general business uses are allowed along with a commercial parking structure, car sales room, drive-in restaurants, storage warehouse, filling station and tourist home, according to the town’s zoning ordinance.

  The property is also in the floodway. Alexander has owned the field where the proposed park was going to go for 30 years.

  Proposed “new buildings” at Alexander’s Old 46 property are on the agenda for project review at the Nashville Technical Review Committee this Thursday, Nov. 4. The meeting is at 1 p.m. in the Nashville Town Hall, 200 Commercial Street.

Oct 29, 2021. I checked with the County Planning Office. They are the ones that approve any building permits in the B3 Zone. They provided the following information:

• A few uses would not require building permits such as creating a public park with no structures. Any use that is considered development in the Floodplain (Fringe areas) would need local floodplain permits. Development in areas of the Floodway district would require permits from the DNR Water Division and local Floodplain Permits. Any structures over 400 square feet to be placed in the FF or FW would have to meet elevation requirements with the lowest floor being elevated to at least 2 feet above base flood elevation (BFE) or for commercial buildings, floodproofed by either elevation or mechanical means. In addition to floodplain permits and building permits for structures, the Nashville DRC would be involved in granting or denying certificates of appropriateness.

  Nashville also has a floodplain ordinance in Town Jurisdiction.

Oct 27, 2021. BZA Meeting. Unanimous NO vote. Brown  County residents at their finest provide “expert testimony” as to the issues and harmful impacts associated with this development.

• If the BZA did not approve the special exception, developer threatened a “Plan B” where he could support projects that comply with the existing Gneral Business (GB) B3 Zoning – Service and Warehouse Business Use, without needing BZA Approval.

  • HOWEVER, He will need building permits that are approved by the County!

Note: We would have fewer conflicting opinions on topics such as this if we had a better Comprehensive Plan. Ours is 14 pages – around 100 would be more appropriate. Vagueness and generalities can be interpreted both ways. Although the plan meets minimum state requirements, it is immoral and unethical to have a plan used for decisions that does not represent the “Voice” of the residents.

 Dear BZA Board,

Based on a review of the County Comprehensive Plan, the submitted project documents, and comments from citizens posted on two Brown County Specific Facebook pages – Brown County Matters and Brown County Chatter (see enclosures), I do not believe this project as described in the submitted documents, is in alignment with the County Comprehensive Plan and in the best interests of the county.

Regarding the Facebook comments, I provided a copy (enclosures) in PDF files to allow for a quick review.  The original posts as well as reactions can be easily viewed on the respective Facebook group pages.

This 185 Site RV Park supports more tourism. A vision for more tourism is not specifically addressed in the County Comprehensive Plan. When is more tourism too much for the infrastructure (including roads) and acceptable by county residents? Andy Rogers recognized the importance of maintaining a balance. His vision was to accommodate tourism and not destroy the culture and “soul” of the county:

• “People say, ‘Well, we can’t change.’ But we can change and still retain some of the flavor of Brown County. We need people to live here. I’m in the tourist business but we don’t want to turn this town over to the tourists. You can go to Gatlinburg if you want to see what happens to a town that turns it all over to business. It’s not a town anymore—it’s a shopping center.

   

• “We don’t need to be slick and highly commercial. We need to be more country. Country is what we sell…. We need to maintain that. Once you destroy that, it won’t come back.”

 The County Comprehensive Plan (14 pages) represents the “Voice” of the residents. Although it meets the minimum requirements by the state, it is too short and vague. This allows for “flexibility” where arguments for or against a project can be equally valid. The plan does not provide the level of specificity that should be needed to make the best decision regarding the proposed 185 Site RV park. The plan does not specifically mention support for a project of this scope to be located on land that is used for agriculture and homes.

Specific Comments – Alignment with the Comprehensive Plan:

01. The 185 Site RV Park is not in alignment with the Count Comprehensive Plan (CCP). The plan mission statement identifies the following: “To provide guidance on decision making regarding Brown County land use, public service and zoning that enhances the quality of life for the residents based on the county’s natural beauty and rural atmosphere.”

• How does this project enhance the quality of life for “residents”? Why would a 185 site RV (mobile home) Park be considered an enhancement to the “natural beauty and rural atmosphere”?
• Enclosures 1 and 2 identify the comments from residents sharing their “Voice” regarding the project. Those that are opposed or have concerns provide more detail regarding their position than the individuals that just commented that they were in favor of the project.

02.  Plan -Introduction. “There is a special need to understand that planning should identify and encourage those land uses that have been positive over time, especially those that contribute to the distinctive character of this “special place” called Brown County. Planning can guard against rapid change and growth that are incompatible with existing infrastructure and the county’s “quality of life vision.“

• There is no history or evidence of how an RV Park of this size has had a positive influence in the county.
• How does a 185 Site RV Park add to the distinctive character of this “special place called Brown County” or “quality of life vision”? This project supports tourism, e.g., more visitors – NOT residents.
• There has been no evidence submitted, nor is it stated in the Comprehensive Plans, that that an increase in the number and size of RV parks are recognizes as a desired outcome.
• Brown County State Park does support camping to include RV Parks, Camping Trailers and Tent Camping. Covid has increased the demand for sites that may be addressed in the future by the Park. Over 50% of the land in Brown County is owned by the state, feds, or non-profit conservation organizations. Land Use for agriculture, residents and appropriate development that serves ALL residents are included in goals in the Comprehensive Plan.

03. Traffic and Safety

• Brown County’s two-lane roads adds a constraint to increases in more visitors. Hard Truth Hills and the Music Center now contribute to more year-round tourism which adds more congestion to our roads.
• The location of the proposed 185 Site RV Park is in close proximity to the intersection of old 46, Highway 46 and the North Gate Entrance to Brown County State Park. This intersection has been known to be among the most congested (and accident prone) in the county at times. The State has refused to put in a stop light. And, if they did put in a light, this would add to the back-up traffic on 46 creating more frustration and adding increased travel time for residents.

Indiana Citizen’s Planner’s Guide. Part 2 Board of Zoning Appeals Basics by KK Gerhart-Fritz, AICP, identifies “Developmental Standards Variance Criteria per IC 36-7-4-918.5”. Specifically:

01. The approval will not be injurious to the public health, safety, morals, and general welfare of the community.

• • As stated above, the project is incompatible with the intent and goals expressed in the County Comprehensive Plan and the “Voice” of the residents.
  • Facebook comments from county specific Facebook groups (see enclosures) do identify residents’ concerns and opposition to this project. The public sentiment as well as the comprehensive plan, would likely support affordable housing for residents in this area.
  • The location of the proposed park does add to traffic congestion and risks to safety. The State may not approve a request for a traffic light and even if they did, this would add to traffic backups and impatient drivers that tend to create condition that may lead to more accidents

02. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse.

• Adding a commercial property in an area consisting of agriculture and homes does have an adverse impact on the “natural beauty and rural atmosphere” as well as morale, that is intended to be protected by the Comprehensive Plan. Further, it sets a bad precedent.

03.The strict application of the terms of the zoning ordinance will result in practical difficulties in the use of the property.

• “Practical difficulty” is adding to the congestion on Old 46 and 46 across from the North Gate to the State Park which will be the main ingress and regress routes. Traffic on old 46 will also be impeded. Luxury RV’s heading west on old 46 to Nashville would certainly add to the traffic congestion.

In conclusion, in addition to this planning guidance, the County Comprehensive Plan represents the “voice” of residents regarding their support for changes. The Facebook comments (see enclosures) provide a strong indication that a 185 Site RV Park is not acceptable.
